Are the seller's other giclee individual items not covered by copyright?

That seller is well-known for taking high res images from RR, Heritage, etc. and selling them on eBay. He usually offers reprints of signed photos... this is the first glicee I have seen.

Legally, I would say yes as to the actual print. However, you can probably find another attorney who says no.
