Auctionata will hold its next Space History Sale from Berlin, Germany, on Jan. 27, 2017 at 3 p.m. EST (2000 GMT). The auction highlights include:
  • NASA flight jacket and boots, ex astronaut Robert Overmyer
  • Paul Calle moon stamp print and letter
  • Soyuz T-5 flown procedure manual, ex cosmonaut Anatoly Berezovoy

I have always thought that certain items could not be sold to non U.S. residents and also could not be shipped outside the U.S.

Lot 4, a flown shuttle tile, is originating in Germany. Is this a legal sale of a flown shuttle tile or does this auction violate ITAR just by the tile's presence in another country?

The auction itself doesn't violate ITAR, but the original owner may have been in violation, depending on how it was obtained and exported.

The tile may have been exported before ITAR was imposed on space shuttle hardware, which I believe started around 1999 (based on Wiki article). Like closing the barn doors long after the horse has left the barn.
